Kang Haggerty was invited for its pivotal role in a landmark False Claims Act (FCA) whistleblower case against Insys Therapeutics, a pharmaceutical company known for its unlawful marketing of Subsys, a fentanyl-based painkiller. Edward and Kandis shared insights on the power of the FCA to combat healthcare fraud and protect public health.

The roundtable featured prominent voices from Harvard, Brown, Penn, and the University of Chicago, and included Pennsylvania Senator Amanda Cappelletti and Congressman Chris Deluzio. The discussion underscored the urgent need for transparency and accountability in veteran healthcare systems. The roundtable was convened by the House Committee on Veterans’ Affairs, led by Ranking Member Mark Takano of California.

Furman asked Kang Haggerty member Kandis L. Kovalsky for her perspective on pursuing claims declined by the U.S. government.Kovalsky explained “This case really shows […]\ that lawyers can make a difference through aggressively handling declined litigation.” Kovalsky also clarified that while the government is more likely to intervene in cases against pharmacies than those against private equity firms, she expects the government to increase its presence in cases against private equity firms in the future. Kovalsky described the potential lasting effect, saying, the settlement with Belhealth Investment Partners serves as a warning to private equity firms in healthcare not to place financial returns above patient well-being.

According to Kovalsky, who represents FCA whistleblowers and is an active member of Taxpayers Against Fraud (TAF), “the Sixth Circuit’s decision … has implications far beyond that case itself” and could have “broad, chilling effects on the FCA’s purpose and reach.”

According to Overley, “The Sixth Circuit delivered a one-two punch to whistleblowers and the U.S. Department of Justice on Tuesday by requiring False Claims Act cases to directly connect kickbacks with health care billing and refusing to view all potentially valuable actions as possible kickbacks.”

Active members of TAF—Taxpayers Against Fraud, Kang Haggerty members Edward Kang and Kandis Kovalsky will present How to Whet Uncle Sam’s Whistle: A Guide to Litigating Cases under the False Claims Act at the National Asian Pacific American Bar Association (NAPABA) 2022 National Convention in November.

Kovalsky told Law360 that she, Wolfe and Kang had worked recently on a large opioid case where the government intervened after a whistleblower complaint. She said that case made it clear the firm could really make a name for itself, weeding out fraud and misconduct through helping whistleblowers bring similar cases, especially in the opioids and health care spaces.

“The opioid epidemic and health care fraud generally, is something we’re particularly interested in and is an area where we feel like we can make a difference for whistleblowers, holding corporate defendants and their executives accountable,” she said.

Wolfe said he’s expecting to see more qui tam cases emerge from the COVID-19 pandemic, especially with fraud related to the COVID relief money distributed as a result of the Coronavirus Aid, Relief, and Economic Security, or CARES, Act.
