The webinar offered in-depth guidance for corporate counsel on navigating veil-piercing claims under the single business enterprise theory. Kang and Gomez examined the evolving legal landscape following the landmark 2021 decision in Mortimer v. McCool, highlighting expanded liability risks for affiliated entities and the shifting judicial approach to disregarding the corporate form.

Both Kang and Gomez are active members of the Legal Netlink Alliance (LNA), a global network of independent law firms committed to collaborative excellence. Kang Haggerty will host the upcoming LNA Fall Meeting in Philadelphia, while EPGD Business Law will welcome members to Miami for the Spring Meeting in 2026.

This program will explore strategy and pitfalls for both relator and defense counsel in pre-trial False Claims Act (FCA) litigation. Topics covered will include a general overview of pre- and post-complaint filings for relators, interactions with the government during their investigation, counseling your clients during the government’s investigation, declined litigation, and settlement.

The panel includes counsel for relators, defendants, and the government, offering perspectives from each of the relevant parties in False Claims Act litigation. Ross will be joined by Nicomedes Sy Herrera, Partner, Herrera Kennedy; Erin Lindgren, Assistant United States Attorney, U.S. Attorney’s Office – Eastern District of Pennsylvania; and Emily McGowan, Partner, Alston & Bird LLP.

Kandis Kovalsky is a member of Kang Haggery LLC and a YLD board member for TAF. Kandis has a particular passion for litigating false claims cases relating to the opioid crisis, including claims for illegal activity committed by drug companies, providers, and pharmacies.

Kang Haggerty members Edward Kang, Kandis Kovalsky and associates Ross Wolfe and Sofia Calabrese will participate in the largest annual gathering of whistleblower attorneys in the nation. Kovalsky and Calabrese are both members of the TAF Coalition’s Young Lawyers Division board.

On September 26^th, Kovalsky will present on “The End of Chevron Defense: How Does Loper Bright Impact Whistleblower Practice,” discussing how Loper Bright will impact the whistleblower space. She is also a panelist on a program about generating business as part of the TAF Young Lawyers Division Conference on September 24^th.

The program will provide varied perspectives from government, relator, and defense counsel on Touhy subpoena practice in declined False Claims Act cases. The conversation will cover the process and procedural elements of Touhy subpoenas, negotiations with the Government, and use of that information in litigation.

The Qui Tam Section of the Federal Bar Association was started in 2015. It provides education, training, and networking opportunities for attorneys involved with the False Claims Act and other whistleblower statutes.
