{"id":5201,"date":"2017-08-24T13:59:01","date_gmt":"2017-08-24T17:59:01","guid":{"rendered":"https:\/\/www.khflaw.com\/?p=4592"},"modified":"2020-09-24T10:13:29","modified_gmt":"2020-09-24T14:13:29","slug":"docs-ties-bind-jason-guss","status":"publish","type":"post","link":"https:\/\/www.khflaw.com\/news\/docs-ties-bind-jason-guss\/","title":{"rendered":"Docs and the Ties That Bind Them"},"content":{"rendered":"<p>Restrictive covenants are contractual clauses that limit an employee\u2019s post-employment activities for a specified length of time and geographic area.\u00a0 Their enforceability varies by state and by profession.\u00a0 For example, restrictive covenants are unenforceable in the legal profession but are enforceable in the medical profession. The American Medical Association, however, discourages restrictive covenants between physicians. Yet it deems them ethical unless they are excessive in geographic scope or duration, or fail to reasonably accommodate patients\u2019 choice of physician.<\/p>\n<p>The determination of whether a restrictive covenant is reasonable is a factual one that is assessed on a case-by-case basis: courts weigh the competing interests of the employee versus the employer, and typically the burden is on the employer to demonstrate that the restrictive covenant protects the employer\u2019s interests without posing an undue hardship on the employee.<\/p>\n<p>In Pennsylvania, restrictive covenants are enforceable if they are incident to an employment relationship between the parties, the restrictions imposed by the covenant are reasonably necessary for the protection of the employer, and the restrictions imposed are reasonably limited in duration and geographic extent.\u00a0 <a href=\"http:\/\/caselaw.findlaw.com\/pa-supreme-court\/1385241.html\"><em>Hess v. Gebhard &amp; Co.
